image-to-text.ai provides AI-powered image analysis services, including but not limited to summarizing image content, converting images to prompts, code, and Markdown.

3. User Accounts

3.1 You may be required to create an account to access certain features of the Service.

3.2 You are responsible for maintaining the confidentiality of your account and password.

3.3 You agree to accept responsibility for all activities that occur under your account.

4. User Responsibilities

5. Payment and Subscription

5.2 Paid subscriptions are billed in advance on a recurring basis.

5.3 You can cancel your subscription at any time, but refunds are not provided for partial subscription periods.

6. Intellectual Property

6.1 The Service and its original content, features, and functionality are owned by image-to-text.ai and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

6.2 You retain ownership of the images you upload to the Service.

7. Content Generated by the Service

7.1 The content generated by our AI models based on your inputs is provided for your use.

7.2 We do not claim ownership of the generated content, but we are not responsible for its accuracy or appropriateness.

8. Limitation of Liability

To the fullest extent permitted by applicable law, image-to-text.ai shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues.

9. Termination

We may terminate or suspend your account and bar access to the Service immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever and without limitation.

10. Changes to Terms

We reserve the right to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect.

11. Governing Law and Dispute Resolution

11.1 These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions.

11.2 Any dispute arising out of or in connection with these Terms, including any question regarding its existence, validity, or termination, shall be referred to and finally resolved by arbitration under the rules of the International Chamber of Commerce, which rules are deemed to be incorporated by reference into this clause.

11.3 The number of arbitrators shall be one. The seat, or legal place, of arbitration shall be Delaware, United States. The language to be used in the arbitral proceedings shall be English.

11.4 Notwithstanding the foregoing, nothing in these Terms shall prevent either party from seeking injunctive relief in any court of competent jurisdiction.

11.5 You agree that any cause of action arising out of or related to the Service must commence within one (1) year after the cause of action accrues. Otherwise, such cause of action is permanently barred.

12. Severability

If any provision of these Terms is held to be unenforceable or invalid, such provision will be changed and interpreted to accomplish the objectives of such provision to the greatest extent possible under applicable law and the remaining provisions will continue in full force and effect.

13. Waiver

Except as provided herein, the failure to exercise a right or to require performance of an obligation under these Terms shall not affect a party's ability to exercise such right or require such performance at any time thereafter nor shall the waiver of a breach constitute a waiver of any subsequent breach.
